SALE CONDITIONS

The following sale conditions, regulate the terms and conditions of sale of products commercialized by GUFO s.r.l.s. All of the sale agreements related to the sale of GUFO products by GUFO s.r.l.s. to third parties are regulated by the following terms and conditions, which form an integral and essential part of any proposal, order and confirmation of purchase of the Products. The conditions of sale related to your order are those in effect at the date of the order.

1. PRODUCTS: PRICES AND FEATURES

1.1 Unless otherwise indicated, the prices of the products published by GUFO s.r.l.s. are VAT included. The prices of products from time to time published by GUFO s.r.l.s. cancel and replace the previous ones and are subject to availability of products. GUFO s.r.l.s. reserves the right to confirm or modify the prices of products posted on its website or in brochures and advertising material at the time of order confirmation to the customer.

1.2  Unless otherwise indicated, product images are indicative and not binding.

1.3  The Customer is responsible for choosing the products ordered in compliance and conformity with the specifications/size set by the manufacturer.

2. ORDERS – BILLING

2.1  All purchase orders sent to GUFO s.r.l.s. should be complete in their entirety and must contain all the elements necessary for the proper identification of products ordered. Each order sent to GUFO s.r.l.s. constitutes a contract proposal from the customers and, therefore, will be binding to GUFO s.r.l.s. only if confirmed for acceptance. The order execution is considered equivalent to confirmation and acceptance thereof.

2.2   GUFO s.r.l.s. reserves the right to not accept orders incomplete or not properly completed. In case of failure to execute the order by GUFO s.r.l.s. (if it is due to unavailability of products ordered by the customer) GUFO s.r.l.s. will soon inform the customers and refund the amount in its entirety if already paid for the supply not performed. In this case the customer is not entitled to any further reimbursement or indemnity or compensation, furthermore the prices  and purchases online on www.gufodesign.com will only be valid for that type of purchase and not for retail sale or from catalogues sale.

2.3  The tax records (receipt or invoice) related to the ordered products will be issued by GUFO s.r.l.s. upon shipment of products to the customer.

3. PRODUCTS DELIVERY

3.1  The delivery costs will be charged to the customer (except in case of promotions).
Deliveries are normally made by DHL, express courier.
The ONLY formula allowed for online purchases is payment in advance.

Delay in delivery less than 10 (ten) working days shall not entitle the customer to refuse delivery of the products, or to claim damages or compensation.

3.4 NATIONAL SHIPMENTS (PROVIDED FOR THE PREVIOUS ARTICLE 3.2)

Your purchase will have a cost of packaging and shipping of € 9,76. The delivery time once the package is shipped is 1-2 working days, depending on the location. The number to track your shipment will be sent by e-mail once the parcel has been shipped. You should check the shipment status by writing your tracking number on the DHL’s website (www.dhl.com). In some period GUFO can make the shipping free.

3.5 SHIPMENTS WITHIN THE EU TERRITORY AND INTERNATIONAL SHIPMENTS (PROVIDED FOR THE PREVIOUS ARTICLE 3.2)

Your purchase will have a cost of packaging and shipping from € 15,00. The delivery time once the package is shipped is 4-6 working days, depending on THE location. The number to track your shipment will be sent by e-mail at the time when the product is shipped.

3.6   GUFO s.r.l.s. has the right to make delivery of products (even on the same order) in successive deliveries,. In this case the customer have to pay only for one shipment.

3.7  Particular conditions and terms of delivery have to be agreed by GUFO s.r.l.s. and the customer and must accepted by putting it in writing.

4. SPECIAL OFFERS

4.1  Any special offer promoted on www.gufodesign.com is valid until the sale of all the stock and in any case, is subject to the availability of related products. The special offers are not cumulative. The products included in special offer could be wrapped in promotional packs (for pack we mean boxes, manuals, etc.).

5. PRODUCT WARRANTY – TECHNICAL ASSISTANCE

Your GUFO® products are guaranteed for a period of 24 months from the date of purchase, in accordance with the terms of this warranty. The international warranty covers any material and manufacturing defect existing at the time when it was sold. The warranty is effective only if you are in possession of a valid receipt. During the warranty period, and upon proof of purchase, you will have the right to repair your product for free in case of defect. If repairs are improper to restore the normal conditions of use of your GUFO® product, or the product is no longer available, we guarantee its replacement with a GUFO® product of the same model/color or similar.

5.1 The sunglasses warranty includes the frame. It does not include:

  • Rupture or scratching of the lens;
  • Wear and deterioration (scratched wood for example, alteration of the material and(or frame color);
  • Any damage to any part of the glasses resulting from misuse or abnormal use, lack of care, negligence, accidents (dents, bumps, broken glass, etc.), damage caused by exposure to water or fire, damage caused by unhautorized repairs or sunglasses alterations from its original condition without the supervision of GUFO®.

5.2 The watches warrany includes  movement, hands and dial. It does not include:

  • Strains or alterations to case, strap, bracelet and glass;
  • Damage due to fire or water (unless the bottom of the casing is marked ewater resistant);
  • Any damage due to accidents, negligence, improper use due to other factos not attributable to material or manufactruing defects.

Here is the procedure:

1. Please refer to our website (Refund Policy) www.gufodesign.com/en/resi
2. Fill in the “Return Form” and press “Send”.
3. Print the filled form and follow the instructions to return the product.
4. Please send all the required information, including the return form correctly filled in and the product to our headquarter: Via Transito, 41 – 95121 – Catania (CT) Italy.

5.3 RETURN OF PRODUCTS: GUFO s.r.l.s. will contact the customer as soon as the product pass the inspection.
The shipping costs to ship the product to the service center will be borne by the sender. The product will be replaced/fixed and returned to you at the GUFO s.r.l.s. expense.

6. RIGHT OF WITHDRAWAL

6.1  According to Article. 5 of Legislative Decree 22 May 1999 no.185, the customer (if can be described as “consumer” under article 1 letter B) of Legislative Decree 22 May 1999 n. 185) has the right to terminate the contract and return the products ordered, without penalty and without specifying the reason, within 14 working days from receipt of the products.

6.2  The right of withdrawal referred to in Article 6.1 must be exercised by the customer, subject to revocation, by sending a registered letter to GUFO s.r.l.s. – Via Transito, 41 – 95121 – Catania (CT) Italy, within ten (10) working days from receipt of the products. The above communication can be sent, within the same period by telegram, email to info@gufodesign.com, by registered letter, within 48 (forty eight) hours.

6.3  All returns (to be completely intact and accompanied by original packaging) must be authorized by GUFO s.r.l.s. Customer Service which will issue a return authorization (RMA). After receiving the RMA number, the customer can return the product to the following address:

We will not accept parcels to be paid by cash on delivery.

6.4  Upon receipt of the products (and verified their integrity) GUFO s.r.l.s., in the shortest possible time, will credit to the customer the cost of returned products (as indicated on the invoice), retaining the amount of shipment that will remain permanently charged to the customer.

6.5  The right of withdrawal referred to in Article 6.1 may not be exercised by the customer in the event that the products have been opened and used by the customer.

7. COMPETENT COURT

Subject to any applicable mandatory provisions of law for the protection of consumers (as defined under article 1 letter B) of Legislative Decree 22 May 1999 n. 185), any dispute related to these Terms and Conditions, shall be under the exclusive jurisdiction of the Court of Catania. Pursuant to and for the purposes of Articles 1341 and 1342 of the Civil Code, the Customer declares to have carefully read and understood and agree specifically the following clauses of the General Conditions of Sale: 1.1, 1.2, 2.1, 2.2, 3.2 , 4.1, 5.1, 5.2, 5.3, 6.2, 6.3, 6.4, 6.5 and 7.
